10 years agoThe gist of our story is, they took money from us, as down payment, did minimal amount of work, and then refused to show up. The owner of the company, Chuck Yost, signed a contract with us on May 20, 2016, for $9800, to perform: 1. removing laminate flooring from the basement and putting down tiles; 2. removing old fence and building a new one; and 3. removing the old deck and building a new one. We paid him a down payment of $3800. They showed up to work on 2 or 3 days, and: 1. removed the laminate floor from the basement; 2. removed most of the old fence but not the posts; and 3. putting tiles on 252 sq. ft, out of 810 sq. ft. This was a very small portion of the agreed-upon work. After that, they never, ever showed up to work, despite our repeated attempts of contact. On July 13, 2016, we signed a new contract, specifying that they should finish by August 7, 2016. Otherwise they would pay us a liquidation fee of $100/day. We asked Chuck Yost explicitly whether they had the capacity to finish. He promised that they did, which was not the first promise he made. Not surprisingly, they did not finish, nor did they show up to work at all, between July 13, 2016 and now. They did not clean up their work area. 1. they dug up large holes near the fence posts. These were potential hazards. They did not fill up the holes . We did. 2. they did not clean up the work area in the basement. And again, we did. As proof for our claim, we have 1. pictures of the holes at the fence posts, and of the work site in our basement. 2. paper copies of their initial quote, the initial contract, and the contract signed on July 13, 2016. 3. proof of payment of $3800 from our bank. 4. trails of our communications with them, in the forms of letters, emails and text messages. Between May 2016 and now, they repeatedly made empty promises, and then refused to even show up to work. This has become a pattern. By not fishing on August 6, 2016, they have also breached the contract. Therefore we do not want them to perform any additional work on our property. Looking at the quote they gave us on 05/05/2016, the value of their finished work was less than $800. So we ask for a refund of $3800 - $800 = $3000, plus a liquidation fee of $500 (5 days from 08/05 to today).
